republican or monarchical State
are so disrupted things in our Argentina, which many officials and provincial governors are convinced that a constitution serves to give more power when the meaning is exactly the opposite, limiting.
While I am going to enunciate is elemental to any reasonably educated citizen, it is worth remembering on the eve of the renewal of mandates provincial elections to be held next August 28.
A Constitution or Magna Carta is a document that aims to ensure objective citizens the free exercise of their rights and freedoms set limits on the power and points out the relationships among the three branches of government: Executive, Legislative and Judicial, and also between them and society.
The first Constitution also known as "Magna Carta Libertatum" was written in England in 1215 and culminating, after many discussions and difficulties, by King John I, called John Lackland. The originality of the document, for those old days, is that a Council or Parliament, limiting the power of the monarch. That first modern constitution (if I may call it that) consisted of 63 articles which not only guarantees feudal rights to the Aristocracy, provided that 25 barons, by a commission controlled the King's power, normalized by the case law that nobody can be prosecuted for the mere will of the sovereign extends security to peasants, artisans and merchants and the monarchy is committed to respect the religious and political freedoms.
But what we call modern constitutionalism actually begins with the liberal revolutions of the eighteenth century, the French Revolution and the U.S.. Exactly in this country, gives the first constitution of republican sign, on September 17, 1787. Process takes hold throughout the following century with the emancipation American nations and the punishment of their respective constitutions.
When a current governor complains that his powers are limited, it seems not to understand that the absolute monarchy ended. Even in countries that still have this system, kings reign but not govern, parliaments are those who exercise power delegated by the sovereign, the people. All current European monarchical regimes are governed by a constitution. The monarch has a symbolic role as head of state representative, but necessarily involves the exercise of power by a Prime Minister who exercises the executive power, a parliament that makes laws and an independent judiciary.
and you tell me what's all this? Tucumán simply because there is a kind of absolute monarchy, which depend not only on the three branches of government, but also the political structure almost in full. Very clear evidence in this regard is given by the numerous posters with the rejuvenated face of our governor, no whiskers and tweaked for the useful photoshop, accompanying with its image in an incalculable number of candidates from varied backgrounds and fur. Is that our local Constitution amended in 2006, has implemented a special system, parties, fronts or electoral alliances, can support a single candidate "Governor and Lieutenant Governor and / or Mayor, (....) can unite the different categories of candidates ballot with the rank of Governor and Lieutenant Governor and / or mayor of another separate list, adding the total votes obtained by the lists in each category . (*) indicates verbatim.
Curious right? Convinced of the need to come under the umbrella of power, a real zoo made up of men and women from the most diverse political tendencies, try to become legislators or councilors, without caring much about a program or project. The important thing is to come.
So we are practicing in a real republican system Tucumán? yourself can draw conclusions, more Republicans may be any of the European monarchies that what prevails today in the Garden of the Republic.
(*) Tucumán Constitution, amended in 2006 Article 43 Inc. 12
